Hadith on Judges: The burden of proof is on the claimant, otherwise people would claim each other’s lives

August 18, 2012

Ibn Abu Malikah reported: I was a judge for Ibn Al-Zubair in the town of At-Ta’if and he mentioned the case of two women. Ibn Al-Zubair said: I wrote to Ibn Abbas and he wrote back to me saying the Messenger of Allah, peace and blessings be upon him, said, “If people were given in accordance with their claims, then men would claim the wealth and lives of other people. Rather, the burden of proof is on the claimant and an oath is an obligation upon him who denies the claim.”
